Mud on the Road

Due to the time of year and likely road conditions, this is a quick message to remind farmers, contractors, landowners, etc. of their responsibilities of clearing mud off the highway following farming operations. Responsibility is on the landowner to ensure that they or anyone acting on their behalf clear the road of mud.

You must make sure clear hazard warning signs are positioned to give maximum visibility and warning to other road users. You are also responsible for cleaning the road as necessary during the working day and always at the end of the working day, and flashing amber beacons should be used on all agricultural vehicles.

 Section 149 of the Highways Act 1980 gives the highways authority the power to clean the road and recover its expenses from the person causing the obstruction.

 There is also a responsibility upon all road users to observe road signs and drive according to the driving conditions on the road.
